Terms and Conditions
General
1. In these terms and conditions of sale
‘The Company’ refers to A and R Willis Catering Trailers and or its sub-contractors
‘The buyer’ means as stated
‘The goods’ means as stated
Conditions
2. These conditions apply to all contracts for the sale of goods by the company to the buyer.
Payment
3. Once an order of goods has been placed the buyer must pay a deposit. This deposit is currently 20% of the full invoice price. This is subject to change with no notification. The deposit is non-refundable unless otherwise stated by the company.
4. Payment of the balance of the goods must be paid upon collection or before delivery of the goods.
5. Unless otherwise stated the price of delivery is not included in the quote. Additional charges may apply for delivery of goods.
6. All payments due by the buyer to the company shall be made in sterling.
Collection and delivery
7. The company shall endeavour to deliver goods by the estimated date but the company will not be liable to the buyer should the buyer encounter any loss or damage sustained as a result of failure to deliver by the estimated date.
8. If the goods are not collected by the buyer or the buyer refuses to accept delivery of goods on the specified date the company reserves the right to resell the goods and keep any deposit.
Guarantees
9. The company guarantees new trailers against any defects in design workmanship, construction or materials for 24 months. All new equipment is covered by a 12 months manufacturer’s warranty from the date of purchase. We cannot be responsible or give any warranty on any equipment that is supplied by the customer. If any problems occur during the 24 month warranty period the company will at its own expense repair or replace the goods upon the customer returning the goods at the customer’s expense to the company’s workshop. The Company will not be liable for any alleged loss of earnings which may occur whilst the goods are being repaired or replaced by the company.
10. These guarantees shall not apply to:
(a) Any defect in the opinion of the company that arises by reason of misuse, misapplication, neglect or accident.
(b) Any defect which is not immediately notified to the company
(c) Components not manufactured by A and R Willis Catering Trailers, in which case the buyer is entitled only to the extent that the company itself is entitled to a guarantee provided by the manufacturer.
Defects
11. It is the buyer’s obligation to inspect all goods at the time of collection/ Delivery. A thorough walk through with detailed advice will be given to all customers upon collection. Any claim in respect to defective workmanship should be acknowledged at the time of collection/Delivery.
12. In the event that goods are delivered by an independent courier, no claim in respect of goods damaged in transit or loss will be accepted if the courier has been given a clear receipt of goods.
Force Majeure
13. If the manufacture, delivery, transport or collection of goods is prevented or interrupted or delayed due to circumstances beyond the companies control the company shall not be liable for breach of contract. We will possess the right to cancel or delay any contract under these circumstances. These circumstances include but are not limited to natural unavoidable catastrophes, war, civil riot, fire, flood, government order or control, any strikes or reduction or loss of power supply or breakdown of plant machinery or shortage of raw materials or any event for which the third party is responsible.
Governing Law
14. All disputes arising out of these conditions shall be subject to the jurisdiction of the courts of England and Wales.
