Formation of Contract
 
We will confirm our acceptance of your order to you by sending you an email (a "Confirmation"). We are not obliged to deliver any goods until payment has been verified and accepted.
 
 
Payment and Price
 
All prices are in £ sterling and are inclusive of VAT at the current rate unless otherwise stated. We reserve the right to change any advertised price before you place an order. Payments can be made by any major credit/debit card via our secure server, by e-mail, fax, telephone or post. Payments made on-line using our secure server are backed by our secure shopping guarantee.
 
In the event that an error is discovered with the price of any goods you may have ordered we will inform you as soon as we can possibly contact you whereupon we will give you the option of amending and processing your order at the correct price or cancelling it. In the possible event that we cannot contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods we will give you a full refund.

Availability of Goods
 
All products and services are subject to availability and may be withdrawn at any time. If owing to non-availability of the goods, you will be offered an alternative or given a full refund at your request.
Orders are sent out by courier and delivery times shown are approx only. Gillman's accept no responsibility for delays on delivery times.
 
We at Gillman’s Appliance Specialists undertake that within 12 months of the date of purchase if your new appliance or any part thereof is proven to be defective by reason only of faulty workmanship or materials we will at our option repair or replace the same free of charge for labour, materials or carriage on condition that:
 
- The appliance has been correctly installed and used on the electricity supply stated on the rating plate.
 
- The appliance has been used for normal domestic purposes only unless sold and invoiced as a commercial product in accordance with the manufacturer's instructions.
 
- The appliance has not been serviced, maintained, repaired, taken apart or tampered with by persons not authorised by Gillman’s Appliance Specialists or the manufacturer.
 
- All service work under this guarantee must be undertaken by the manufacturer's service representative or our authorised agent.
 
- The guarantee is in addition to your statutory and other legal rights.
 
- Manufacturer's home visits, under guarantee, are made between 8.30 a.m. and 5.30 p.m. Monday to Friday. Visits may be available outside these hours in which case a small charge will be made.

Gillman’s will exchange or refund your purchase up to 14 days following the day of delivery, the item must be returned unopened and in its original packaging, complete with any free gifts or accessories provided
 
 
 
Your cancellation rights
 
 
 
Your right to cancel
If you are a consumer, you have a legal right to cancel your contract with us (a "Contract") under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 during the period set out below. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep the goods, you can notify us of your decision to cancel the Contract and receive a refund. Advice about your legal right to cancel the Contract is available from your local Citizens' Advice Bureau or Trading Standards office. Your legal right to cancel a Contract starts from the date of the Confirmation (the date on which we e-mail you to confirm our acceptance of your order), which is when the Contract between us is formed. Your deadline for cancelling the Contract then depends on what you have ordered and how it is delivered, as set out in the table below:
 
 
The Contract End of the cancellation period
The Contract is for a single item of goods. The end date is the end of 14 days after the day on which you receive the item of goods.
 
Example: if we provide you with a Confirmation on 1 January and you receive the item on 10 January you may cancel at any time between 1 January and the end of the day on 24 January.
The Contract is for multiple items of goods which are delivered on separate days. The end date is 14 days after the day on which you receive the last of the separate items of goods ordered.
 
Example: if we provide you with a Confirmation on 1 January and you receive the first of your separate items of goods on 10 January and the last of the separate items of goods on 15 January you may cancel in respect of any or all of the separate items of goods at any time between 1 January and the end of the day on 29 January.
 
 
 
To cancel a Contract, you just need to let us know that you have decided to cancel. The easiest way to do this is to complete the cancellation form on our website. (A link to the website cancellation form will be included in our Confirmation). If you use this method we will e-mail you to confirm we have received your cancellation.
 
 
 
You can also e-mail us at cancellations@gillmans.co.uk or contact our Customer Services team by telephone on 01452 528776 or by post to Mercia Road, St. Oswalds Road, Gloucester, GL1 2SG. If you are e-mailing us or writing to us please include details of your order to help us to identify it. If you send us your cancellation notice by e-mail or by post, then your cancellation is effective from the date you send us the e-mail or post the letter to us. For example, you will have given us notice in time as long as you get your letter into the last post on the last day of the cancellation period or e-mail us before midnight on that day.
 
 
 
If you cancel your Contract we will:
 
(a) refund you the price you paid for the goods. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop.
 
(b) refund any delivery costs you have paid, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method we offer (provided that this is a common and generally acceptable method).
 
(c) refund you the price you have paid for any installation services. If however you have expressly requested us to commence any installation services before the end of 14 days after the date on which you receive the Confirmation, you acknowledge that the right to cancel such installation services shall be lost once installation shall be fully performed and you shall not be entitled to a refund of the price of the installation services where the right to cancel has been lost.
 
(d) make any refunds due to you as soon as possible and in any event within the deadlines indicated below:
i. if you have received the goods and we have not offered to collect them from you: 14 days after the day on which we receive the goods back from you or, if earlier, the day on which you provide us with evidence that you have sent the goods back to us. For information about how to return a goods to us, see below;
ii. if you have not received the goods or you have received them and we have offered to collect them from you: 14 days after you inform us of your decision to cancel the Contract.
 
 
 
If you have returned the goods to us because they are faulty or mis-described, we will refund the price of the goods in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us.
 
 
 
We will refund you by the same method you originally used to pay.
 
 
 
If goods has been delivered to you before you decide to cancel your Contract:
 
(a) then you must return the goods to us without undue delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the Contract. You can either send the goods back or return them to us in-store at Mercia Road, St. Oswalds Road, Gloucester, GL1 2SG. If we have offered to collect the goods from you (and you may contact us to request us to consider offering to collect the goods from you), we will collect the goods from the address to which they were delivered. We will contact you to arrange a suitable time for collection;
 
(b) unless the goods are faulty or not as described, you will be responsible for the cost of returning the goods to us. If the goods cannot be returned by post, we estimate that if you use the carrier which delivered the goods to you, these costs should not exceed £30.00 for major appliances (eg dishwasher, cooker) or £10.00 for a small appliance (eg kettle, toaster) . If we have offered to collect the goods from you, we will charge you the direct cost to us of collection. We charge £30.00 for major appliances (eg dishwasher, cooker) or £10.00 for a small appliance (eg kettle, toaster).
 
 
 
Because you are a consumer, we are under a legal duty to supply goods that are in conformity with this Contract. As a consumer, you have legal rights in relation to goods that are faulty or not as described. These legal rights are not affected by your right of return and refund or anything else in these terms. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.
 
 
 
 
 
For returns of items purchased in the showroom please refer to our Gillman's Notice to Customers and Cancellation Policy, as displayed within the store.
 
 
 
 
Delivery dates are estimated at all times and may be delayed without prior notice, which is why we strongly advise all customers not to book fitters until they have received the relevant goods, as no claims will be accepted. Whilst we make every reasonable attempt to deliver promptly and within the estimated time frame, we cannot be held responsible for sudden stock shortages or manufacturing delays. Please note that we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in delivering goods.
 
Whilst our own drivers are happy to wheel your product into an unobstructed room on the ground floor if you require the appliance to be on any other floor please ensure you request this through the comments section, we will then confirm to you any extra charges that may apply due to using a two man delivery. We cannot be held responsible for any damage incurred. It is the customer's responsibility to protect any floor and or wall coverings to prevent damage while the products are being situated in the property.
 
Labour carried out by our own fully qualified engineers carry’s a 60 day guarantee, starting from the day after the date of the appointment.

Although the main photo accompanying the eBay listing currently features an image of a Miele FJM HyClean '3D Efficiency' box, the item actually received was a Miele FJM Hyclean 'Pure' box. That said, they appear to be the same vacuum cleaner bags, albeit strangely with different names (perhaps for geographical-market-distinction reasons). The seller may nevertheless wish to update their listing photos to reduce the risk of possible confusion among buyers. Thank you for the prompt dispatch.
